You Pay Taxes Even When You Lose: The New OBBBA Law Threatens to Transform Poker in the US
Yesterday, US Congress and President Trump approved the sweeping One Big Beautiful Bill (OBBBA), which among other things, alters tax rules for gamblers. From January 1, 2026, poker players will only be able to deduct 90% of their losses, while 100% of their winnings will remain taxable. The result: even players who break even could face a tax bill on “phantom income.”
